Nevada written safety programme requirements

Nevada has a specific written safety-programme requirement. The right starting point is Nevada Revised Statutes (NRS) 618.383 and the related Nevada Administrative Code (NAC), not a generic federal OSHA programme checklist. Employer headcount affects the statutory exemption and safety-committee duty; explosives manufacturing is an important exception.

This article explains how to organise the decision and records. It does not approve an employer's programme or replace the current law for a particular site.

Check the threshold and special case

Under NRS 618.383, an employer with 10 or fewer employees is exempt from that section unless employees are engaged in the manufacture of explosives. Once the exemption does not apply, the employer must establish a written safety programme and carry out its requirements within 90 days after the programme is established. NAC 618.538 adds a specific establishment timing rule for an employer entering business in Nevada after 18 May 1994: it must establish the programme within 60 days after its eleventh Nevada employee is hired. The 60-day establishment and 90-day implementation provisions address different steps; do not combine them into one deadline.

NRS 618.383 also requires a safety committee if an employer has more than 25 employees or employees manufacture explosives. The committee must include employee representatives; special selection rules apply where employees are represented by a labour organisation. The 25-employee trigger is not the threshold for having a written programme. Record the Nevada employee count and date used for each decision, and check how the statute applies to the actual employer rather than assuming each facility is a separate employer.

Write the programme around work that can be demonstrated

The statute requires employee safety training, with particular attention to recurring injuries or explosives manufacturing. The programme and training must be made available in a language and format employees understand. NAC 618.540 specifies the operational contents: responsibilities of management, supervisors and employees; methods to identify, analyse and control hazards; safety training before work duties; accident investigation and corrective action; and enforcement of safety rules. Where a committee is required, the written programme must explain member selection, purpose, duties and meeting frequency.

A useful programme names the people, decisions and records at each step. For a new hazard, who receives the report, who assesses exposure, who chooses a control and who verifies closure? For an incident, who investigates, which corrective actions are assigned and how are workers told what changed? The regulation permits an equivalent programme only with the Administrator's approval; an employer should not self-declare a generic manual โ€œequivalentโ€.

Keep the evidence that the programme runs

NAC 618.542 requires written records of committee issues and meeting attendance where a committee is required, plus employee training attendance. Those records must be maintained for three years and available to the Division on request. The law also calls for site-specific training for employees supplied by a temporary employment service before work at each site or as soon as possible afterwards. Keep the programme version, training records, committee records and corrective-action trail together so a reviewer can see implementation rather than a document alone.
