Do I have to have a written safety program?
OSHA’s General Duty Clause (Section 5(a)(1) of the OSH Act) requires every employer to provide a workplace free from recognized hazards. Many specific OSHA standards — Hazard Communication, Respiratory Protection, Lockout/Tagout, Bloodborne Pathogens, Confined Spaces and more — require a written program. Several states (for example California’s IIPP, and Injury and Illness Prevention Program requirements elsewhere) make a written program mandatory outright. Even where it is not strictly required, a written safety and health program is the single most useful document you can hold: it is what an OSHA compliance officer, a GC prequalifying you, or an insurer will ask for first. OSHA’s Recommended Practices for Safety and Health Programs set out the core elements — management leadership, worker participation, hazard identification and assessment, hazard prevention and control, education and training, and program evaluation. Always check osha.gov and your state plan for the requirements that apply to you.
